Welcome to TrackEDU ("we," "us," or "our"). These Terms & Conditions ("Terms") govern your access to and use of our website, teacher dashboard, student application, and related services (collectively, the "Platform"). By using our Platform, you agree to these Terms and our Privacy Policy.
2.1 Staff accounts. Only teachers and school administrators may create accounts on TrackEDU. You must be an authorized representative of your school to register.
2.2 No student accounts. TrackEDU does NOT offer student signups, student passwords, or student email collection. Students access the student tool using auto-generated anonymous ID tokens (e.g., "EMWA482") and class passcodes (e.g., "BRAVE") that are generated by the Platform and provided by their teacher.
2.3 No PII for students. Because students never create accounts, we do not collect student emails, home addresses, phone numbers, or any personally identifiable information beyond first name + last initial (for display purposes only).
3.1 Free Pilots & Design Partners. We may offer free pilot programs (such as the Early Adopter/Design Partner program). These programs are granted at our discretion and provide temporary free access to the Platform in exchange for product feedback. We reserve the right to modify or terminate free pilots at any time.
3.2 Paid Subscriptions. Platform access is billed annually based on total student enrollment, subject to a minimum annual contract floor. Prices are clearly outlined in your customized quote or invoice. Fees are non-refundable except as required by law.
3.3 Automatic Renewal. Paid subscriptions renew automatically unless you cancel at least 30 days before the renewal date.
3.4 Fair Use. We reserve the right to modify plan features, limits, and fair-use thresholds to maintain system stability and performance.
Staff account holders agree not to:
Students access the student tool using teacher-provided ID tokens and class passcodes. Because there is no student account creation, no login credentials, and no email collection, students are not subject to these Terms directly. However, schools agree to ensure students use the tool appropriately and in accordance with school policies.
Students cannot: (a) view other students' personal information beyond first name + last initial; (b) award points to themselves or others; (c) change their house assignment; or (d) access administrative features.
House points awarded through the Platform are for motivational and educational purposes only. They have no cash value, cannot be exchanged for real-world goods or services outside your school's internal reward system, and are not transferable. Schools retain sole discretion over how points translate to rewards or recognition.
7.1 Your content. Schools retain full ownership of all student data and house point records submitted to the Platform.
7.2 Platform IP. We own all rights in the Platform, including the 3D holographic badge designs, user interface, gamification mechanics, and brand assets.
7.3 Feedback. If you send ideas or suggestions, you grant us a perpetual, irrevocable license to use them without restriction or payment.
Because TrackEDU does not require student accounts, emails, or passwords, we collect no personally identifiable information (PII) from students beyond first name + last initial (for display in leaderboards).
Our data handling practices are described in our Privacy Policy. Our architecture is designed to support school compliance with FERPA, COPPA, and GDPR where applicable — and our no-account design inherently reduces compliance burden for schools.
9.1 Cancellation. You may cancel your paid subscription at any time. Upon cancellation, your access will continue until the end of your current billing period.
9.2 Data Retention. Following cancellation or termination, your data will be retained for 90 days, during which you may request an export. After 90 days, all data is permanently deleted.
9.3 Self-Service Wipe. School Administrators may perform a "Full System Wipe" from their dashboard at any time, immediately deleting all school data from our servers.
We may suspend or terminate staff account access immediately for violations of these Terms, legal risk, security concerns, or non-payment.
The Platform may link to third-party sites or integrate third-party tools (e.g., YouTube for tutorials, Cal.com for demo bookings). We are not responsible for third-party content, policies, or practices.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT). WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACKEDU WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE PRECEDING 12 MONTHS.
You agree to indemnify and hold harmless TrackEDU from any claims arising from: (a) your violation of these Terms; (b) your school's administration of house points or rewards; or (c) any dispute between you, your students, or parents regarding point allocation.
We may modify these Terms. Material changes will be posted with an updated "Last Updated" date. For paid customers, we will notify you via email at least 30 days in advance.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where the operating entity of TrackEDU is legally registered. Any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration or in the courts of that jurisdiction. The prevailing party shall be entitled to recover reasonable legal fees and costs.
